Acceptance of Terms

By accessing or using Moonlight Energy's services, website, or any related content, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use our services.

Use of Services

  • Eligibility: You must be at least 18 years old or the age of majority in your jurisdiction to use our services.

  • Account Creation: You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.  

  • Prohibited Conduct: You agree not to use our services for any illegal, harmful, or unauthorized purposes.

Intellectual Property

  • Ownership: All content and materials on Moonlight Energy's website and services, including but not limited to text, graphics, logos, images, and software, are the property of Moonlight Energy or its licensors and are protected by intellectual property laws.

  • Limited License: Moonlight Energy grants you a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes.  

Disclaimer of Warranties

Moonlight Energy's services are provided "as is" and without any warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or secure.

Limitation of Liability

To the maximum extent permitted by law, Moonlight Energy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the services;

  • Any conduct or content of any third party on the services;

  • Any unauthorized access, use, or alteration of your transmissions or content.

Entire Agreement

Indemnification

These Terms constitute the entire agreement between you and Moonlight Energy regarding the use of the services and supersede all prior and contemporaneous communications and proposals, whether oral or written, between you and Moonlight Energy.

You agree to indemnify, defend, and hold harmless Moonlight Energy, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:  

  • Your access to or use of the services;

  • Your violation of these Terms;  

  • Your violation of any applicable laws or regulations.

Governing Law and Jurisdiction

These Terms and any dispute arising out of or related to these Terms or the services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Modifications to Terms

Moonlight Energy reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

Termination

Moonlight Energy may terminate or suspend your access to the services at any time, with or without cause, and with or without notice.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
